Companies Inspected on Labor Law Compliance

The Department of Labor and Employment (DOLE) has intensified its inspection campaign to make sure that employers are complying with the country’s labor laws.

In a statement, DOLE Secretary Rosalinda Baldoz said that the intensified inspection program is contained in Administrative Order No. 281, which outlines the implementing guidelines of Project Labor Enforcement and Action Program (LEAP).

According to Sec. Baldoz, Project LEAP is part of DOLE’s share in the reform process of the new administration that aims to protect workers’ rights through the attainment of a culture of compliance with labor laws among establishments nationwide.

Project LEAP will have two phases. Phase one will start from August 2, 2010 until November 30, 2010. The second phase will stretch through the months of February to November 2011. The project will cover all establishments employing 10 to 199 workers. Priority establishments include security agencies, manpower agencies, subcontractors, cooperatives, manufacturing establishments, restaurants, and fast food enterprises. Other establishments other than the said companies will also be inspected but on a non-priority basis.

Priority areas include major cities, urban centers, special economic zones, industrial estates, and other areas having the highest concentration of establishments eligible for inspection.

Among the core labor standards to be inspected are compliance on minimum wage, emergency cost of living allowance (ECOLA), 13th month pay, holiday pay, service incentive leave, overtime pay, night-shift differential, Social Security System (SSS), Home Development Mutual Fund (Pag-ibig) and Philhealth contributions.

DOLE aims to inspect at least 35,680 establishments throughout the project’s duration by utilizing all 223 labor and technical safety inspectors in the 16 DOLE Regional Offices nationwide. Each office is tasked to inspect 10 establishments per week.

The Labor chief stressed that the protection of workers’ rights is a primary component of President Benigno Simeon 'Noynoy' Aquino III’s agenda on labor and employment.

Pinoy Nurses Seeking Employment in US Drops by 33%

Filipino nurses seeking employment in the US has declined by as much as 33% in the first semester of the year compared to the same period last year.

In a statement, Trade Union Congress of the Philippines (TUCP) Secretary-General and former Senator Ernesto Herrera said that 5,553 Filipino nurses took the National Council Licensure Examination (NCLEX) for the first time from January to June, down 2,719 or 33 percent from 8,272 in the same period of 2009.

The NCLEX refers to the licensure examination administered by the US National Council of State Boards of Nursing Inc. Passing the NCLEX makes a Filipino nursing graduate eligible to work in the state where he or she has qualified for.

The said decrease of the examinees is a reliable indicator on how many Filipino nurses aim to work in the United States. In addition, the former senator noted that Manila-based labor recruitment agencies previously reported that more Filipino nurses are now leaving for the United Kingdom than those going to the US.

“Filipino nurses and other highly skilled professionals will go to foreign labor markets where it is easier for them to enter and work, and where they will get the best reward in terms of pay and other benefits,” SecGen Herrera added. Furthermore, he said that applicants base their choice of country on personal circumstances, professional qualifications and the job offers they receive.

The labor leader said that the Philippines is still America’s biggest supplier of foreign nurses, followed by India, South Korea, Canada and Puerto Rico. Based on statistics from the UK’s Nursing and Midwifery Council, India and Australia are the biggest supplier of nurses in United Kingdom, since both are former British colonies. The Philippines, on the other hand, is now Britain’s third-biggest supplier of foreign nurses.

A total of 15,382 Filipino nurses took the NCLEX for the first time in the whole of 2009, a decrease of 5,364 or 2% from 20,746 in 2008, the statement noted.

In 2007, a total of 21,499 Filipino nurses took the NCLEX for the fi1rst time, an increase of 6,328 or 42% from 15,171 in 2006. The 2006 figures were up 65% or 5,990 compared to the 9,181 Filipino nurses that took the NCLEX for the first time in 2005. Some 82,000 Filipino nurses took the NCLEX for the first time over the last five years.

PNoy's first SONA Not a Holiday

Malacanang Palace has announced that President Benigno Simeon ‘Noynoy’ Aquino III’s first State of the Nation Address (SONA) on July 26, 2010 will not be declared a holiday.

According to Presidential Spokesman Edwin Lacierda, the Palace had to consider the side of the business sector in declaring Monday as a regular working day event with the SONA. Furthermore, he said that they are not worried about the rallyists who have organized to stage protest rallies near the Batasang Pambansa or the House of Representatives where Mr. Aquino is set to deliver his first SONA. Mr. Lacierda also said that it is the decision of the Quezon City government whether to declare Monday holiday, particularly in the areas near the Batasang Pambansa.

Meanwhile, the Department of Education (DepEd) announced that public schools in the Batasang Pambansa and Commonwealth Avenue area will have no classes on Monday in line with PNoy’s first SONA. DepEd communications unit chief Kenneth Tirado said that administration of private schools in the affected area are expected to make their own announcement on class suspensions in line with the said event.

On Monday, President Aquino will address the Congress for the very first time after being sworn into office last June 30. In earlier reports, the President promised to deliver a ‘straightforward’ SONA with no gimmicks. His first SONA will discuss about the country’s current status, what the administration has done for the past few weeks and their plan of action for the next six years.

OFW Remittance in May Hit Record High

Remittances from overseas Filipino workers (OFW) coursed through banks in May 2010 to reach US$1.6 billion, the highest monthly remittance level recorded by the Bangko Sentral ng Pilipinas (BSP).

BSP Governor Amando M. Tetangco, Jr. said, in a news release, that the cumulative remittances for the first five months of the year amounted to US$7.4 billion, higher by 6.6 percent compared to the same period a year ago. Increased remittances were noted from both sea-based and land-based workers, expanding by 8.8 percent and 6.0 percent, respectively.

The steady stream of remittances continued to emanate from the stable demand for professional and skilled Filipino workers worldwide as well as the wider access of overseas Filipinos and their beneficiaries to a broader array of products and services offered by banks to cater to the various needs of their clients, including facilities for payment of utility bills and food delivery from selected food chain stores with established tie-ups.

“These are the key factors that support the optimistic outlook for sustained remittance flows through the rest of 2010”, said Gov. Tetangco.

Preliminary data obtained from the Philippine Overseas Employment Administration (POEA) indicated that for the first half of the year, approved job orders aggregated 302,844, of which about 35 percent consisted of processed job orders for service, professional, technical, and production and related workers. The bulk of these processed job orders were intended for the manpower requirements of Saudi Arabia, United Arab Emirates and Taiwan.

Apart from these prospective employment opportunities, the POEA also reported the deployment in May this year of 119 selected health workers comprising the second batch of nurses and caregivers under the Japan-Philippines Economic Partnership Agreement (JPEPA) which was implemented in 2009.

The main country sources of remittances were the U.S., Canada, Saudi Arabia, Japan, the U.K., Singapore, United Arab Emirates, and Italy. The combined flows from these countries represented 81.5 percent of the total remittances reported by the banks.

Wage Boards Still Hearing 8 Petitions – DOLE

After the approval of the wage increase for Metro Manila minimum wage earners, eight other petitions are still being heard by the Regional Tripartite Wages and Productivity Boards (RTWPBs).

There are at least eight petitions pending. The petitions range from P50 to P128.60 across-the-board (ATB) daily wage increase, and RTWPBs concerned are currently holding a series of sectoral consultations and public hearings on said petitions, Department of Labor and Employment (DOLE) Secretary Rosalinda Baldoz, in a news release, said.

The Trade Union Congress of the Philippines (TUCP), who filed for the P75 wage increase in Metro Manila, also filed for a P75 ATB increase in Region 4-A, Region 10, and Region 11; P50 ATB in Region 6 (together with the Philippine Integrated Industry) and Region 9; P65 ATB in Region 4-B; P60 ATB in Caraga; and P100 ATB in Region 7. The Alliance of Progressive Labor and the Shemberg Employees Independent Union, also filed a separate P128.60 ATB wage increase for Region 7.

The DOLE chief also said that the RTWPBs of Region 7 (Central Visayas) and Caraga Region are in the advanced stages of consultations and deliberations and are expected to issue their wage orders soon. The provinces of Bohol, Cebu, Negros Oriental, and Siquijor comprise Central Visayas. The Caraga region, on the other hand, is composed of Agusan del Norte, Agusan del Sur, Dinagat Islands, Surigao del Norte and Surigao del Sur, and the cities of Butuan, Surigao, Bislig, Cabadbaran and Tanda.

The other wage boards tackling the petition are CALABARZON (Cavite, Laguna, Batangas, Rizal and Quezon), MIMAROPA (Mindoro, Marinduque, Romblon and Palawan), Western Visayas (Aklan, Antique, Negros Occidental, Capiz, Guimaras and Iloilo), Eastern Visayas (Biliran, Eastern Samar, Leyte, Northern Samar, Samar and Southern Leyte), and SOCCSKSARGEN (South Cotabato, Cotabato, Sultan Kudarat, Sarangani and General Santos City).

Last June 8, the National Capital Region (NCR) RTWPB issued Wage Order No. 15 granting a P22.00 daily wage hike to all NCR minimum wage earners in the private sector. The rules and regulations for the wage order were issued last June 29, 2010 and the wage increase took effect July 1, 2010.

The wage order sets the new minimum wage in the NCR at P404.00 per day for non-agricultural workers and P367.00 for workers in agriculture, private hospitals with bed capacity of 100 or less, retail/service establishments with 15 or less markers and manufacturing establishments with less than 10 workers.

As in previous wage orders, a one-year exemption may be granted to certain types of establishments, such as distressed establishments, retail/service establishments regularly employing not more than 10 workers, establishments whose total assets are not more than P3 million, and establishments adversely affected by natural calamities. Deadline for the filing of exemption to the wage increase is on September 15.

Newly Appointed DOLE Chief vows worker protection, social dialogue


Ms. Rosalinda Dimapilis-Baldoz said that she vows to uphold worker protection and promote social dialogue between between employers and trade unions as she assumes the position as the new Department of Labor and Employment http://www.dole.gov.ph (DOLE) Secretary.

Outgoing Labor Secretary Marianito Roque formally handed the post to Sec. Baldoz by last Monday, July 5 at the DOLE office in Intramuros, Manila during a well-attended turnover ceremony. Baldoz during the turnover acknowledged and thanked Sec. Roque for his contributions to the DOLE and to the country, particularly in the area of overseas employment.

Sec. Baldoz said the DOLE under her leadership shall strengthen tripartite consultation and cooperation and improve labor standard compliance.
Furthermore, the new Labor chief said that she will work closely at hand with the Department's social partners in protecting the rights of overseas Filipino workers and combating human trafficking and illegal recruitment. For local workers, Sec. Baldoz aims to solve the long-time issue of skill-job mismatch, as well as aid jobseekers in searching for work. She also vowed to implement reforms in the labor and arbitration procedures to restore integrity and fairness in the system by ensuring speedy disposition of pending labor cases with quality decisions.

Prior to becoming the Labor chief, Mrs. Baldoz is a career executive service officer (CESO) who has served the DOLE for the past 36 years. She has worked as Mediator-Arbiter of the DOLE’s Bureau of Labor Relations (BLR); Labor Arbiter of the National Labor Relations Commission http://www.nlrc.dole.gov.ph/ (NLRC); Executive Director of the National Conciliation and Mediation Board http://www.ncmb.ph/ (NCMB), and Administrator of the Philippine Overseas Employment Administration http://www.poea.gov.ph/ (POEA).

Dutch Ship Companies Want All-Filipino Crew in Vessels

Netherlands Ambassador to the Philippines Robert Brinks said that Dutch shipping companies want to have an all-Filipino crew, from officers to ratings (non-officer) to man their vessels.

In an statement made during the 11th meeting of the Philippines-Netherlands Joint Committee on Maritime Affairs, Ambassador Brinks said that Dutch employers prefer Filipino seafarers to occupy key positions in their vessel because of their good communications and technical skills. On the other hand. Mr. Tjitso Westra of the Dutch Ship Owners Association added that Filipinos seafarers can do a lot of functions, reliable, and has a sense of loyalty to their employers.

Despite being affected by the global financial crisis, Ambassador Brink said that this has not affected the hiring of Filipino seamen for Dutch ships. He revealed that since Asia's economy is booming, there will always be a requirement for them.

Based on reports, Filipinos make up about a quarter of all seafarers all over the world, totaling to more than 250,000. Like The Netherlands, Japan and Norway ships prefer to have Filipinos as part of their crew.

Aquino Extends Contractual Employees, non-CESO officers

Less than 24 hours after assuming office, President Benigno Simeon 'Noynoy' Aquino III ordered the issuance of Memorandum Circular No. 1, extending the contracts of all contractual employees of Malacanang and other government offices.

The memorandum, according to Presidential Spokesperson Edvin Lacierda, was issued "to prevent the unnecessary disruption of government operations and the impairment of all processes and transactions as well as delivery of services to the people."

Based on the memorandum, contractual and/or casual employees whose contract expired in June 30, 2010 shall continue their services until July 31, 2010. These includes the employees at the Internal House Affairs Office which include Malacañang chefs and other kitchen, housekeeping, and maintenance personnel.

Moreover, non-career executive service officers (CESO) occupying career executive positions in all agencies of the Executive branch “'will remain in office and continue to perform their duties and discharge their responsibilities until July 31, 2010 , or until their resignations have been accepted and/or until their respective replacements have been appointed or designated, whichever comes first. ”

In addition, for agencies whose head has resigned or deemed separated as of June 30 and the current administration has not named a replacement, the next-in-rank and most senior officer will act as Officer-in-charge until such time a new head has been appointed or designated.

As for the presidential appointees of the former administration who are co-terminus with the term of former President Gloria Macapagal-Arroyo or are in excess of the authorized staffing pattern in all departments are deemed separated from office. These includes chairs of numerous government owned and controlled corporations, as well as different departments in the government.

The said memorandum, initially issued las June 30, was 'fine-tuned' since the first version had some ambiguous sections and caused confusion regarding the status of employment of those non-CESO occupying CES positions.

Davao Hailed as Top Next Wave BPO City for 2010

Davao City was hailed as the top 'next wave' city for business process outsourcing (BPO) in the Philippines by Business Processing Association of the Philippines (BPAP), Commission on Information and Communications Technology (CICT), and the Department of Trade and Industry (DTI).

Davao scored 99% score for talent, 95% for infrastructure, 74% for cost, and 76% for business environment, averaging a total of 91% to take the top spot. In an interview, BPAP chief executive Oscar R. Sanez said that Davao City was choses as the best city for IT-BPO operations due to the avialability of graduates and talented workers as well as infrastructure. The low score of the Crown Jewel of Mindanao is due to the travel advisories issued against going to the city. He also explained that Davao bested Metro Laguna, last year’s topnotcher, because of a revision in the scope of available talent category.

The other nine cities included in the list are Sta. Rosa, Bacolod City, Iloilo City, Metro Cavite (composed of (Bacoor, Imus, and Dasmariñas City), Lipa City, Cagayan de Oro City, Malolos City, Baguio City, and Dumaguete City. The last two cities were not included in last year's list since Clark was still part of the list. But when it was elevated as an established city, joining the ranks of Metro Manila and Metro Cebu.

BPAP Executive Director for Information and Research Gillian Joyce G. Virata said that the 'new wave' city list aims “to promote these cities so they have something to sell to investors and help them convince investors to build and invest in their cities'.

Based on reports, Davao currently hosts 20 outsourcing companies, employing 6,500 workers. Philippine BPO industry and employed around 442,000 employees and garnered revenues of $7.2 billion last year, the latter a 19% gain from 2008’s $6.06 billion.
