Malacanang Declared May 3 as Regular Holiday

Malacanang Palace has declared May 3, 2010, a Monday, as a regular holiday in celebration of Labor Day, which falls on May 1, a Saturday.

Based on Proclamation No. 2043, issued by Executive Secrtetary Leandro Mendoza, follows the mandate of Republic Act 9849 which states that regular holidays, specifically Labor Day, will be celebrated on Monday nearest to May 1. Furthermore, the proclamation emphasized that “a longer weekend encourages families to get together and strengthen their relationship towards a more productive environment, as well as promotes domestic tourism, and enables employers to plan their schedules effectively and efficiently, resulting in improved productivity.”

May 1, 2010 was initially declared as a regular holiday based on Proclamation 1841, signed last July 31, 2009. But the latest proclamation issued last April 28 repealed this and formally declared Monday as a regular holiday.

In this light, the Department of Labor and Employment (DOLE)has released its pay rules guidelines regarding to be applied on May 3, 2010.
  1. If the holiday falls on an employee’s regular workday:
    • If worked, the employee is entitled to 200% of his [or her] basic wage for the first eight (8) hours and, for work in excess of the 8 hours, to an additional 30% of his or her hourly rate on the said day.
    • If unworked, the employee is entitled to 100% of his or her regular daily rate, provided he or she was present, or was on leave with pay, on the workday immediately preceding the holiday.
  2. If the day is the employee’s rest day:
    • If worked, the employee is entitled, for the first 8 hours, to 200% of his or her daily rate plus 30% and, for work in excess of 8 hours, plus 30% of his or her hourly rate on the said day.
    • If unworked, the employee is entitled to 100% of his or her regular daily rate, provided he or she was present, or was on leave with pay, on the workday immediately preceding the holiday.
  3. Where the day immediately preceding the holiday is a non-work day in the establishment or the scheduled rest day of the employee, he or she shall not be deemed on leave of absence on that day, in which case he or she shall be entitled to the holiday pay.

DOLE Secretary Marianito Roque said that the activities in celebration of Labor Day will still commence, particularly Jobs Live! Jobs and Livelihood Fair happening on SM Malls in Metro Manila and other declared venues nationwide.

DOLE to Stage Nationwide Job Fair on Labor Day 2010

Following the success of last year's nationwide job and livelihood fair, the Department of Labor and Employment (DOLE) said that they are again preparing for a nationwide Job and Livelihood Fair to be held simultaneously in various parts of the country on May 1, 2010 to mark Labor Day in honor of the Filipino workers.

DOLE Secretary Marianito Roque said the Job and Livelihood Fair, aptly titled, Jobs Live!, will showcase the collaboration of the social partners in the efforts to facilitate the employment of workers while celebrating at the same time the 108th Labor Day anniversary on May 1 this year

Sec. Roque said the country's biggest labor groups such as the Trade Union Congress of the Philippines (TUCP), National Alliance of Trade Unions (NATU), Federation of Free Workers (FFW), Trade Unions of the Philippines and Allied Services (TUPAS), Alliance of Filipino Workers (AFW), and other labor organizations will lead the May 1 celebration with the theme Manggagawang Pilipino, Kaagapay sa Pagbabago. The theme underscores the crucial role of the workers in the national efforts to achieve development and an opportunity to pay tribute to the Filipino workers, both local and overseas.

The main event will be held at the SMX Convention Center at the SM Mall of Asia Complex in Pasay City. To avoid heavy concentration of jobseekers at SMX, the employers and recruitment/manning firms will also be distributed and placed in five other Job and Livelihood Fair venues at SM Megamall, SM North EDSA, SM Fairview, SM San Lazaro, and SM Southmall in Las Pinas. Much like last year's Jobapalooza, job and livelihood fairs will likewise be held in 14 other key regional sites around the country.

Sec. Roque said jobseekers are encouraged to register with the PhilJobNet (http://phil-job.net/) starting April 8 to April 30, 2010 to hasten skills and job matching and the placement of qualified applicants.

He added that a One-Stop Shop where new graduates and other new entrants to the labor force may avail of pre-employment documentation services from the Department of Foreign Affairs, National Statistics Office, Bureau of Internal Revenue, Social Security System, and Philippine Health Insurance Corporation (PhilHealth) will also be set up at the Job Fair venues. Workers may also inquire on the services of Home Development Mutual Fund (Pag-IBIG Fund), Professional Regulation Commission, and FFW.

Aside from the job fair, the venues will also showcase the livelihood programs of DOLE and other government agencies to provide livelihood opportunities to interested clients. It will include display and selling of products of livelihood program beneficiaries. Various government agencies including labor groups will put up livelihood and productivity information booths to provide business counseling and entrepreneurship orientation to interested workers. Interested registered nurses who want to venture in other health and wellness services may also be assisted under Project EntrepeNurse. At the same time, the Technical Education and Skills Development Authority (TESDA) will conduct skills competition, demonstration, and training. Other agencies will provide basic medical and first aid services, and legal and welfare assistance.

DOLE Reiterated Pay Rules for Holy Week

Now that the Holy Week has passed, the Department of Labor and Employment (DOLE) reiterated the pay rules to be applied for April 1 (Maundy Thursday) and 2 (Good Friday), declared as regular holidays and April 3, 2010 (Black Saturday), a nationwide special non-working day.

The Labor and Employment Chief said that Presidential Proclamation No. 1841, issued earlier on July 21, 2009, had affirmed the regular holidays on April 1 and 2. At the same time, Proclamation No. 2029, by authority of the President signed by Executive Secretary Leandro R. Mendoza on March 24, 2010, declared Saturday, April 3, 2010, which falls between Good Friday and Easter Sunday, as a special (non-working) day throughout the country, citing that, “our people must be given the full and uninterrupted opportunity to ponder on the significance of the Holy Week and to properly observe its traditions… without prejudice to public interest.”

Sec. Roque thus advised the country's employers in the private sector to follow the pay rules for the said nationwide regular and special non-working holidays as follows:
  1. For the regular holidays on April 1 (Maundy Thursday), April 2 (Good Friday) 2010:
    1. If the holiday falls on an employee’s regular workday:
      • If worked, the employee is entitled to 200% of his [or her] basic wage for the first eight (8) hours and, for work in excess of the 8 hours, to an additional 30% of his or her hourly rate on the said day.
      • If unworked, the employee is entitled to 100% of his or her regular daily rate, provided he she was present or was on leave with pay on the workday immediately preceding the holiday.
    2. If the holiday is the employee’s rest day:
      • If worked, the employee is 30% of his or her hourly rate on the said day.
      • If unworked, the employee is entitled to 100% of his or her regular daily rate, provided he or she was present or was on leave with pay on the workday immediately preceding the holiday.
    3. Where the day immediately preceding the holiday is a non-work day in the establishment or the scheduled rest day of the employee, he or she shall not be deemed on leave of absence on that day, in which case he or she shall be entitled to the holiday pay.

  2. For the special non-working day on April 3, 2010 (Black Saturday):
    1. If worked, the employee is entitled to 130% of his [or her] daily rate for the first 8 hours, and to an additional 30% of his or her hourly rate on the said day for work performed in excess of 8 hours.
    2. If unworked, he or she is not entitled to any payment, unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment for special days even if not worked.
    3. If worked and falling on the employee’s rest day, the employee is entitled for the first 8 hours to 150% of his or her regular daily rate, and for work performed in excess of 8 hours, plus 30% of his or her hourly rate on the said day.
The same ruling also applies for April 9, 2010, declared as the Araw ng Kagitingan or Day of Valor. Any clarifications regarding the holiday pay rules may be made with the DOLE Call Center at (632) 527-8000.

Over 20, 000 jobs created through SVEG Program

More than 20,000 jobseekers benefited from the special visa for employment generation (SVEG) program of the Bureau of Immigration (BI) since its launch in April 2009.

According to the report of BI legal officer Cris Villalobos, 126 foreign businessmen availed of the job visa and have paved the way for almost 20,000 workers residing in Metro Manila to find a job.

Aside from Metro Manila, 45 foreigners and their dependents availed of the SVEG from Region IV, comprising of the provinces of Batangas, Laguna, Cavite and Quezon. Companies of these SVEG holders employed at least 6,977 Filipino employees. Other 151 SVEG holders are based in Regions 1, 2, 3, 6, 7, 10, 11, and 12 and created 6,327 jobs for Filipino workers.

A breakdown of the list of visa recipients showed that 128 Koreans topped the list, followed by 42 Chinese, 24 Americans, 18 Taiwanese, 13 Indians, 12 Britons, 11 Japanese, nine Australians, six Singaporeans and four German nationals.

The visa entitles the foreign holder to stay indefinitely in the country for as long as his or her investment subsists.

Under the rules, a foreigner applying for the visa shall certify that he or she maintains a lawful immigration status in the Philippines; engaged in a viable and sustainable business; exercises managerial acts with authority to employ, promote and dismiss employees; and evinces a genuine intention to indefinitely remain in the country.

The SVEG was launched by the government to attract foreign investors to the country and at the same time generate job opportunities for Filipinos.

Mr. Villalobos, who heads the BI-SVEG one stop shop, also disclosed that the government earned more than P5 million since the government launched the program last year.

NSO Revealed Results of January 2010 Labor Force Survey

Based on the latest Labor Force Survey (LFS) of the National Statistics Office, the number of employed persons in January 2010 was estimated at 36.0 million, increasing by 5.0 percent over last year’s estimate of 34.3 million persons. This placed the country’s current employment rate at 92.7 percent.

Underemployed workers, on the other hand, were estimated at 7.1 million, compared to October 2009 estimate of 6.9 million and January 2009’s 6.2 million. Underemployed means an employed person expresses the desire to have additional hours of work in their present job or to have additional job, or to have a new job with longer working hours.

The unemployment rate for January 2010 declined to 7.3 percent from 7.7 percent posted in January of 2009. This placed the number of unemployed persons to 2.8 million, down by 100,000 compared to last year.

Among the regions, only the National Capital Region (NCR) posted a double digit unemployment rate of 10.8 percent. It also scored the lowest employment rate at 89.2 percent. Last October, NCR’s unemployment rate was at 11.8 percent and an employment rate of 88.2 percent.

The report also showed that more males were unemployed than females. Across educational groups, most of the unemployed were high school graduates with 33.1%. College undergraduates comprised about 19.3 percent of the unemployed, while the college graduates, 18.5 percent.
